Planning Department

 

Planning refers to land use planning, as well as the various applications that may be submitted to a municipality in  accordance with the Planning Act.  It is primarily intended that persons submitting land use planning applications are responsible for the costs associated with that application.  In those situations where an application could involve costs to be incurred by the Township in the review of an application, a deposit may be required to ensure these costs are paid for by the applicant and are not costs that have be borne by the general taxpayers of the Township. 

Applications and Fees Schedule

Fees and deposits are applicable on a per application basis. If multiple applications are submitted as parts of a complete proposal, the fee associated with each application applies.

Should the approval of an application be appealed to the Ontario Municipal Board (OMB) by a third party, the applicant may elect to withdraw the application or have the Township defend the approval granted. However, should the applicant elect to defend the approval, it is important to note that the applicant is responsible for all costs incurred by the Township in the defence of the applicaiton. To this end, a deposit in the amount of $5,000 in Canadian Funds must be submitted to the Township to cover these costs in advance of any defence being launched.

Any person submitting an application to the Township may appoint an agent to represent him/her during the application process. An Agent Authorization form must be completed and should be submitted with the application to which it pertains.

Quinte Conservation Authority

The Quinte Conservation Authority reports on most land use planning applications and particularly on applications where development is proposed that would have an impact on matters under the authority of this body.  The Quinte Conservation Authority supports a user pay system and as such fees could be applicable to the conservation authority for their review of particular applications.  This fee structure was updated in 2012.

Kingston Frontenac Lennox & Addington Health Unit

Pursuant to an understanding between the Health Unit and the Township early in 2012, the Health Unit assumed responsiblity for applications for the installation of waste disposal systems in the Township.  As a result of this understanding, the Health Unit also provides comments on the suitability of a parcel land for the installation of a waste disposal system when a division of land is being proposed either through the severance process or by plan of subdivision.

The Health Unit has established a schedule of fees intended for the cost recovery of the services they provide.  Fees for the services provided by the Health Unit are paid directly to the Health Unit and are not considered part of any application fee charged by the Township.  It is suggested that proponents of land development applications review this Fee Structure in advance of any application being submitted.

Green Energy and Green Economy Act

The Ontario Green Energy and Green Economy Act has made it easier for people and organizations to develop renewable energy projects.  New processes and programs have been developed with the intent to make Ontario a North American leader in attracting clean energy projects and green jobs.

To assist in developing new renewable energy projects, the province has established the Renewable Energy Facilitation Office (REFO), a one-window access point for where individuals, communities and municipalities with projects of all sizes can obtain information and connect with the appropriate government and agency resources.

Non-Agricultural Source Materials (NASM)

NASM are materials obtained from non-agricultural sources that can be applied to agricultural land to provide valuable nutrients to soil and crops (fertilizer).  Examples of NASM include sewage bio-solids, pulp and paper bio-solids, leaf and yard waste, fruit and vegetable peels and food processing waste. Ontario's rules and guidelines for the land application of the materials were developed by the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) with extensive consultation of industry and environmental organizations, scientists and various other stakeholders. NASM has been safely applied to Ontario farmland for more than 30 years.
